Family law matters, more than any other area of law, touch us at the very heart of our being. They usually involve our children, our most precious assets, financial uncertainty, and often many other changes that accompany the breakup of a family. Manuel A. Juarez, Esq., understands how difficult these times can be. He views it as his job to accomplish two main tasks for you: First, to guide you through the legal aspects of the separation, and to help you reintegrate yourself into your new status. Second, to the extent possible, and with the help of the legal system, to help you restore wholeness and provide for your security where applicable.
Manuel A. Juarez, Esq. provides a special emphasis on the financial aspects relating to a dissolution or legal separation. He is a skilled negotiator, and will make sure that you receive what you are entitled to the fullest extent permitted by the law. His goal is always to settle if possible, since that is in your best financial interests; however, he will litigate if needed, and is an experienced and aggressive litigator.
In Family Law matters time is always of the essence. We strongly encourage you to visit an attorney as quickly as possible if you are contemplating a dissolution or legal separation. You should be apprised of your rights ahead of time.
Debunking the myth:
Myth #1: "You will not get anything financially out of the divorce." That is not true! You are entitled under California law to fifty percent of the community property.
Myth #2: "If you leave me you will never see the children again." Another untrue statement. California law allows for visitation and shared custody provided that the parents are fit parents.
Myth #3: "If you leave me you will have to sell the family home." Yet another untrue statement. California law gives the judges in the matter discretion, depending on the circumstances of each case. You need a skilled attorney who can present your best possible case.
Myth #4: "You will not get the child support." Again, not true. It depends on the circumstances of the case, but California courts will almost always provide for the financial well-being of the children in some manner, and will adjudicate this to the parent most able to provide that support. Contact an attorney early to make sure you preserve your rights.
Myth #5: "You will not get any spousal support." Another myth to keep the spouse hostage. Depending on the circumstances of the case, you may very well be entitled to spousal support.
There are a million different statements made by spouses to preserve what they consider to be their own best interests, irrespective of your best interests. We strongly encourage you to call our office as soon as possible to discuss your unique circumstances.
